1 Booking your accommodation arrangements and services

 

i. When you wish to confirm your booking you must pay either a non refundable deposit to secure your reservation at the time of processing your booking or if your booking transaction date is within six weeks of the commencement of the service then you will be required to pay the full amount.

ii. On some occasions should you wish to take advantage of and confirm what may be deemed as a specially negotiated deal, special offer or promotion, it may be necessary for you to secure your reservation by paying the full amount at the time of booking.

iii. The required payment to secure your reservation will be made known to you at booking stage via our website and all bookings processed are subject to our cancellation policy, amendment policy and these terms and conditions of booking.

iv. Bookings for young persons under the age of eighteen years old will not be accepted unless one member of the travelling party is eighteen years old at the time of booking, is the lead name on the booking and is the credit card holder that pays for the reservation. It is also a requirement that the parent or guardian of any minors travelling in a young party provide written authorisation to us giving their legal consent for their minor to travel.

v. It is a requirement that you and all members of your travelling party have full travel insurance in place to cover them against every eventuality including cancellation and curtailment cover as well as full medical cover prior to processing a reservation with us. We strongly recommend that you take out insurance prior to processing your reservation or within 7 days of processing your booking and you agree to indemnify us against any claims or losses incurred as a result of you or any member of your party not being insured or being inadequately insured with respect to your booking. If you already have travel insurance in place then please check your policy carefully prior to confirming your reservation to ensure that it covers you for the travel services that you are confirming. If your cover is insufficient then you travel at your own risk.

vi. Upon us accepting your reservation and issuing our booking confirmation to you, unless any discrepancies are brought to our attention as per section (1.5) of these terms and conditions of booking, it will be deemed that you are confirming your acceptance of this Booking Contract on behalf of all persons included on the booking, which forms the basis of contract between us.

2 Paying for your booking

i. You agree to pay monies to Bedbookers.Net Limited in consideration for the goods and/or services provided to you under this agreement or that have been contracted by the company on your behalf either in our capacity as a principle or as an agent. We further guarantee the financial protection of consumer funds through The Bedbookers Financial Protection Plan where all consumer funds are held in trust as per the requirements of the Package Travel, Package Holiday and Package Tours Regulations 1992 (or any statutory amendment, replacement or re-enactment thereof).

ii. If you pay the monies referred to in clause 10.1 above by credit or debit card, and you receive a refund of any such sums either by way of a charge back via your card issuer or under section 75 of the Consumer Credit Act 1974 (or other rule or regulation in any relevant jurisdiction) , you hereby assign to Barclays Bank PLC all your rights in this agreement corresponding to such refund including the right to recover such sums from the Bedbookers Travel Protection Plan

iii. You must make pre-payment to us of any outstanding balance shown on your booking confirmation at least six weeks prior to the check in date listed on your booking confirmation or if your booking is made within this period you will be required to pay the full amount immediately to secure your reservation.

iv. If you do not pay in full by the balance due date shown on booking confirmation we reserve the right to cancel your booking and you will be liable to pay the cancellation charges as set out in our cancellation policy section of these terms and conditions of booking.

v. You agree that it is your responsibility to settle outstanding balance payments on the due date specified on our booking confirmation and should you fail to settle any outstanding funds on the balance due date specified then we reserve the right to immediately cancel your booking and you will be liable to pay the cancellation charges as set out in our cancellation policy section of these terms and conditions of booking.

vi. It is illegal to use somebody else’s credit card to make payments on your behalf without their prior knowledge or consent. Should you wish to use a different persons credit card to make payments, even if they are travelling in your party then we will require a faxed copy of both sides of their credit card and their written authorisation from the registered card holder confirming that they have agreed to make payments on your behalf.

3 Making amendments including name changes

i. If you wish to make any changes to your booking, including name changes, once we have issued your booking confirmation, but outside the cancellation period outlined in our cancellation policy section, the lead name person on the booking must advise us immediately in writing to info@bedbookers.com and we will do our best to help. However, verbal requests will not be accepted and we may not always be able to meet your request and have no obligation to do so. Where it is possible to meet your request, the total booking cost will be recalculated in accordance with any new arrangements taking into consideration any applicable cancellation fees or other charges payable and a new confirmation invoice issued. Unless otherwise agreed in writing, you agree to pay us a non refundable administration fee of £15.00 per booking in addition to a non refundable amendment fee of £15.00 per name change. This must be paid by you at the time of processing your requested amendment.

4 Transferring your booking

i. If you are prevented from travelling, you may transfer your booking to another person or group, as long as you give us at least 21 days notice, in writing, and the arrangements remain exactly the same as the original booking. You must also agree to pay any additional charges including administration fees or cancellation charges that we may incur or levy to make this change. The person that you transfer your booking to must comply with all the terms of the existing booking and you will remain responsible for the payment of any outstanding monies should that person fail to pay.

ii. 1.1.If you wish to transfer your booking to a different accommodation then you may do at an administration charge of £15.00 per booking providing that the cost of the new arrangements is greater than your original reservation costs and is travelling within the same season. If you wish to change your booking arrangements to a property of a lower price value to that of your original reservation then this will be treated as cancellation with loss of deposit and, if applicable, cancellation charges as set out in our cancellation policy section and it will be necessary for you to re-book another accommodation at the new price.

5 Cancelling your booking

i. If you cancel your booking the lead named person on the booking must advise us in writing, preferably by email, post or facsimile immediately. Verbal cancellations will not be accepted. If you cancel any element of your booking including individual rooms and individual passengers then you will be liable to pay the full cancellation charges as notified to you at the time of booking and a listed on your booking confirmation.

ii. Due to the individual nature and specific terms and conditions that may apply to any specially negotiated offer or promotion such as early booking discounts, free night offers and promotions in general where it is necessary for you to secure your reservation by paying the full amount at the time of booking a different amendment or cancellation policy may apply. Where you have undertaken to confirm such an offer, these reservations are usually non changeable and non refundable and if you decide to cancel your booking, the cancellation fee will be applicable to 100% of the total booking cost.

iii. If one member of your party wishes to cancel then this may mean that the accommodation booked will be under-occupied and may result in the remaining guests having to pay applicable supplements to retain the booking, for example, when changing a twin room to a single room.

iv. If you cancel your holiday on the day of arrival due to circumstances which are beyond our control, compensation or refunds will not be payable by ourselves and any such claims should be forwarded to your travel insures.

v. Should you decide to curtail your stay for whatever reason, no refunds will be payable for any unused nights of accommodation. Subject to the other terms held within these booking conditions, no refunds will be made in respect of any accommodation or other services which are not used for whatever reason.

6 Whilst in resort

i. If you wish to make any changes to the booked arrangements whilst in resort, for example upgrading your accommodation, changing resort or extending or reducing your stay, all such requests will be subject to availability and any extra costs, including cancellation charges, administration charges and amendment fees and must be met by you and on some occasions paid locally whilst you are in resort.

ii. This alters the basis of your booking contract with us; therefore it is essential that such changes are arranged through us in writing, through our local agent/representative, area office or, if this is not possible, through our head office in the UK.

iii. The accommodation booked is only available for use by those persons included on the booking unless otherwise agreed by us in writing. You are responsible for any damage caused to your accommodation, except by persons not known to you or us and unconnected with the contract between us, during your stay and any charges levied by the owner/hotel manager or third party accommodation provider in this respect must be met by you and paid locally.

iv. Please remember that you are a guest at your accommodation and the owner/hotel manager may remove anyone whose behaviour is disruptive or affects the enjoyment of other guests.

7 Problems whilst overseas & complaints procedure

i. In the unlikely event that you have a complaint whilst you are staying at the accommodation you must bring it to the immediate attention of the hotelier or the management staff. This procedure is an E.C. requirement and gives the hotelier the opportunity to resolve your grievance immediately, to a satisfactory conclusion.

ii. If for some reason your complaint cannot be resolved by the hotelier then you must contact the third party accommodation provider’s local representative by telephoning their emergency local contact numbers that are listed on your accommodation voucher. Providing that your grievance is genuine, the local agent will listen to your complaint sympathetically and try to resolve any problems with the hotelier on your behalf.

iii. In the event that your complaint remains unresolved and you wish to take the matter further then you must do so whilst you are in resort by formally registering your complaint against the hotelier or the third party accommodation provider in writing. Any claims for compensation or recompense must be negotiated and dealt with directly between you and the hotelier or third party accommodation provider listed on your accommodation voucher as per the compensation section of these booking conditions and you agree to indemnify us and our associated companies against any claims of compensation, refund or recompense without exception.

iv. We take ever complaint seriously, therefore should your complaint remain unresolved on your return, after every effort was made by you to adhere to the complaints procedure, and you would like us to act in the capacity of an intermediary in helping you to conclude the matter, then you should write to us within 28 days of your return to allow us to investigate it properly. You will need to provide us with your booking reference number and enclose all the supportive documentation that was supplied to by the hotelier or third party accommodation provider and any copies of documentation that you supplied to the parties in question. Upon receipt of your letter and documents we will send you an acknowledgement, investigate the points raised and endeavour to reply within 28 days with our findings or, if this is not possible, send you an interim letter advising of our progress.

8 Special requests

i. We do not guarantee the accuracy or completeness of any information contained in or i. We will always pass on any special requests to third party accommodation providers so that they may be passed onto your hotelier on your behalf. However, special requests do not form any basis of the contract between you and us are provided at the hotelier’s discretion and cannot be guaranteed.

9 Administration charges

i. We reserve the right to levy an administration charge in certain circumstances to cover any additional costs incurred by us, such as contacting suppliers to check availability, special requests, returning lost property, special documentation dispatch, extra administration relating to requesting that additional rooms be added onto bookings and the re-issue of duplicate documents should they become lost or misplaced by you. This cost is usually £15.00 per booking, but may be higher under certain circumstances.

10 Indemnification

i. You agree to indemnify and hold each of Bedbookers.Net Ltd and its associate or affiliate companies and their officers and employees harmless of any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your use of this site, or the violation of our terms and booking conditions by you, or the infringement by you, or any other person or persons on your booking, of any intellectual property or other right of any other person or entity.

11 Jurisdiction

i. This contract is governed by the law of England and Wales and the jurisdiction of the Courts of England and Wales.

ii. No employee or representative of this company has the authority orally to vary these terms and conditions or the information within this site, or company literature or to enter into verbal agreements with customers of this company
